Obama Letter Confirms He had Classified Documents in Furniture Warehouse

OBAMA LETTER: “The Obama Foundation agrees …to support the move of CLASSIFIED and unclassified Obama Presidential records” from the furniture warehouse at the “Hoffman Estates to NARA-controlled facilities[.]”

To add to the report that Obama had his presidential records stored in a furniture store, now we have this report from PJ Media’s Matt Margolis: (Sept. 22, 2022)

[A] 2018 letter from the Obama Foundation to the National Archives and Records Administration (NARA)… available on the Obama Foundation website and dated Sept. 11, 2018, reveals that the Obama Foundation not only acknowledged possessing classified documents but also admitted that they kept them in a facility that did not meet NARA standards for the storage of those documents.

Trump Lawyer James Trusty: DOJ is Very Politicized (Video, Transcript)

Here are some highlights of what James Trusty, Trump lawyer and former federal prosecutor, said on Fox News today regarding the latest news about the FBI raid on Trump’s Mar-a-Lago home (i.e., the need for a special master, the redacted affidavit, AG Garland, etc.)

Keep in mind: On Friday, Biden’s DOJ released a heavily redacted affidavit used for the Mar-a-Lago raid. During the weekend we learned a judge said she’d consider having a special master to look at Trump’s documents taken during the FBI raid on August 8, 2022. The DOJ responded they have already been through all the documents and no special master is needed.

HIGHLIGHTS OF WHAT TRUMP LAWYER JAMES TRUSTY SAID ON FOX NEWS
RE: DOJ saying there is no need for a special master:

– They (the DOJ) had an opportunity to use a unilaterally imposed filter team.
– We didn’t have a voice on how they set up a filter team.
– We still need judicial intervention. We need a judge to monitor our access to these documents. We have not had a single phone call from the filter team telling us anything. This is the first knowledge we had about their finding on attorney-client privilege. They decided to ignore the concept of executive privilege – which is an interesting wrinkle.
– They’re ignoring the Presidential Records Act, which we think is the incredibly important overlay for all of this.
So we have a lot of problems really accepting everything at face value that’s coming out of DOJ these days. It is a very politicized place – I’m sad to say.
– There is still a need for a judge to get involved on every aspect of this. Checking their assertions of privilege but also giving us fair, timely access, letting us build a case for why the search warrant was not only essentially morally wrong but legally wrong.

RE: Parallel with Hillary Clinton case of classified documents that she kept on private server
– There is a striking difference between the two situations [Hillary and Trump].
– Hillary Clinton had no protection under the Presidential Records Act. That has nothing to do with her at all in terms of how you actually classify these documents as only presidential or personal. The classification doesn’t matter.
– She had a personal server — a tremendously more insecure way of having access to documents than some papers under lock and key in a basement of a place where the Secret Service is on guard as well.
– [Hillary’s obstruction] You had not only documents being destroyed but devices being destroyed that were under subpoena in Hillary Clinton’s case.
– So we think the chronology of cooperation by President Trump and his lawyers at the time it’s devastating to this idea of some sort of willful violation of law. It really shows a President who was accommodating.

Re: Affidavit with all the redactions: (Received on Friday)
– [The affidavit] leaves out June 3rd (2022). It leaves out the day when the DOJ was allowed to walk around Mar-a-Lago, look at the storage facility and assess things. And the advice they came up with 5 days later was, “Hey, put up a lock on the door, please.” That is not the stuff of an urgent nuclear-based espionage-type investigation. That’s the stuff of an overdue library book and some people that are, perhaps, holding this President [Trump] to a different standard than anyone else.

RE: Attorney General Merrick Garland
– Outside of this case I have seen an awful lot of behavior by this Attorney General that is concerning to me.
– [Garland] has no belief in Federalism.
– He is doubling up on civil right cases left and right for the chasing of the headline.
– He is targeting parents who have the temerity to challenge CRT [Critical Race Theory] in Virginia.
– It is a very politicized Dept. of Justice.
– Somehow, someone needs to stand up and do the right thing in DOJ and recognize that this is a fool’s errand, that they should not have been pursuing this, that it is political in nature, it is not criminal. And someone needs to step up.

RE: Representing Trump and criticism of Trump lawyers
– There’s a lot of barbs that come with this territory, right? It’s a cheap way of attacking President Trump to also attack his lawyers.
– We are not going to let it distract us. We got an important job to do – a client who is in a really historical position here in terms of stepping back and thinking about the bad history being made by doing this search warrant, by having an attorney general have press conferences to announce sealed documents under the guise of transparency and then holding off on the affidavit like they are with their fists tightly wrapped around the actual evidence.
– It’s really an honor to represent the President and I’ll take the barbs and slings because it is important for all of us in this country to rein in a political DOJ and FBI.

Judge announces ‘preliminary intent to appoint a special master’ to review Trump records seized by FBI:
– “U.S. District Judge from the Southern District of Florida Judge Aileen M. Cannon on Saturday afternoon said that the decision was made upon the review of Trump’s submissions and “the exceptional circumstances presented.””
– “”Pursuant to Rule 53(b) (1) of the Federal Rules of Civil Procedure and the Court’s inherent authority, and without prejudice to the parties’ objections, the Court hereby provides notice of its preliminary intent to appoint a special master in this case,” Cannon wrote in a filing Saturday.”

Unsealed Trump Affidavit: Response from Former Law Clerk (Video, Transcript)

DOJ redacted version of affidavit used to raid former President Trump’s home was unsealed today.

Mike Davis, former law clerk of Justice Gorsuch, was on Fox News’ America Reports @1:38PM ET and gave his take:

This heavily redacted affidavit further evidences that this home raid on President Trump was unprecedented, it was unnecessary, and it was unlawful. And again, what I’ve been saying since August 8th, the President has the absolute constitutional authority to declassify anything he wants for any reason that he wants. He doesn’t have to get permission from any bureaucrat at the National Archives to do that. That is confirmed by a 1998 Supreme Court case Department of the Navy vs. Egan [see below]. So, there goes the underlying potential charge of espionage that was in this warrant.

Second point: The President has the sole statutory authority to make the determination whether a record is a personal record that belongs to him or a presidential record that goes to the bureaucrats at the National Archives and it almost certainly gets sent back to the president to put in his – the former president’s library. That is confirmed by a 2012 decision by an Obama judge related to Judicial Watch and Tom Fitton’s lawsuit against president Clinton related to 8-years of audiotapes in his sock drawers.

So, what is left? They are looking at obstruction. Well, it is legally impossible for a former President to obstruct investigations into non-crimes. The Justice Dept. did not have the power to even look at these crimes. It doesn’t matter what the evidence shows in this affidavit. No matter what that evidence shows, as a matter of law, it is legally impossible for President Trump to have committed espionage or to have violated some presidential records act.

The Presidential Records Act actually contemplates that former presidents have classified records. It does not differentiate. Congress gives former presidents office space – secure office space. They give the former presidents: staff, security clearance, secret service protection to guard these paper records.

And there is no allegation that any of these records got into the wrong hands unlike Hillary Clinton’s home server where she had foreign governments hack the most highly classified secrets in our government and she did not get an FBI raid.

So, what was so urgent that caused the Biden Administration Justice Dept. to go get these records. And I think it is because President Trump declassified and made personal a copy – his copy of the CrossFire Hurricane records – the Russian collusion records – and the Biden Justice Dept. never made them public because they are so damning on Obama, Hillary Clinton, the FBI and intel community.

The President, after all, is the “Commander in Chief of the Army and Navy of the United States.” U.S. Const., Art. II, 2. His authority to classify and control access to information bearing on national security and to determine whether an individual is sufficiently trustworthy to occupy a position in the Executive Branch that will give that person access to such information flows primarily from this constitutional investment of power in the President and exists quite apart from any explicit congressional grant.

Judge ruled in 2012 that a president’s discretion to declare records “personal” is far-reaching and mostly unchallengeable.

U.S. District Judge Amy Berman Jackson in Washington D.C. ultimately rejected Judicial Watch’s suit by concluding there was no provision in the Presidential Records Act to force the National Archives to seize records from a former president.

But Jackson’s ruling — along with the Justice Department’s arguments that preceded it — made some other sweeping declarations that have more direct relevance to the FBI’s decision to seize handwritten notes and files Trump took with him to Mar-a-Lago. The most relevant is that a president’s discretion on what are personal vs. official records is far-reaching and solely his, as is his ability to declassify or destroy records at will.

“Under the statutory scheme established by the PRA, the decision to segregate personal materials from Presidential records is made by the President, during the President’s term and in his sole discretion,” Jackson wrote in her March 2012 decision, which was never appealed.
