The Georgia Court of Appeals has tentatively set arguments for Oct. 4 in a bid by former President Donald Trump and his allies to remove Fulton County District Attorney Fani Willis and her office from the case involving an alleged effort to overturn the results of Georgia’s 2020 presidential election.

The appeals court said in May that it would review a decision from Fulton County Superior Court Judge Scott McAfee that allowed Willis to continue prosecuting the case against Trump. Arguments will be heard by Judges Trenton Brown, Todd Markle and Benjamin Land.

The proceedings before the Georgia Court of Appeals will delay the start of any trial, and no date has been set for it to begin.

Steve Sadow, Trump’s attorney in the Georgia case, confirmed that oral argument before the appeals court is tentatively set for Oct. 4.

Georgia court makes major ruling on Fani Willis’ sweeping election case against Trump:

In a major setback to the Fulton County District Attorney, the Georgia Court of Appeals on Wednesday put a pause on any proceedings related to the 2020 election interference case against former President Trump and co-defendants until it hears the case to disqualify Fani Willis in October.

The appeals court has tentatively scheduled a hearing date of Oct. 4 for the appeal by Trump and his co-defendants to have embattled Willis disqualified from the case due to an “improper” affair with former special prosecutor Nathan Wade.

The Georgia Court of Appeals has ordered a stay of all proceedings in Fulton County against President Trump and the other defendants seeking to disqualify Fani Willis, pending the outcome of our appeal.

Trump and the eight co-defendants had asked the Georgia appeals court in March to hear their arguments accusing Willis of prosecutorial misconduct over her [sexual] relationship with former special prosecutor Nathan Wade.

Fulton County Judge Scott McAfee had previously ruled that the embattled DA could remain on the case as long as her former lover stepped down — which he subsequently did.
Trump’s appeal seeks to have McAfee’s decision overturned before his case heads to trial.
His legal team argues that Willis’ entanglement with Wade amounted to a conflict of interest, and that the DA misused public funds by benefitting from her boyfriend’s earnings when he took her on lavish vacations.
Earlier this week, the Georgia Court of Appeals tentatively set arguments in the effort to oust Willis for Oct. 4.

Proceedings were derailed earlier this year after one of those co-defendants, GOP operative Michael Roman, claimed Willis and Wade had an improper romantic relationship and alleged Willis financially benefited from it.

Roman claimed the relationship began before Wade was hired in November 2021 to work on the case involving Trump, and he sought to have Willis and her office disqualified and the charges dismissed. Trump and seven others joined Roman’s motion claiming the prosecution was invalid and unconstitutional.
