Lawsuit: DOJ Must Release Hunter Biden Info re: Transporting Prostitutes Probe

Oversight Project Files Motion in Delaware Case Over Hunter Biden Records

The Heritage Foundation’s Oversight Project filed a motion Friday [June 14, 2024] in its case in Delaware against the Department of Justice (DOJ) for records related to the Hunter Biden investigation.

The motion seeks to compel production of records that shed light on the scope of the Justice Department’s examination of whether Hunter Biden violated the Mann Act, a 1910 law prohibiting the transportation of prostitutes across state lines, and whether DOJ fulfilled its obligations under federal law to Hunter Biden’s alleged victims.

Mike Howell, executive director of the Oversight Project, commented on Friday’s filing:

“While you shouldn’t transport prostitutes within state lines, it is clearly a federal offense to transport them across state lines. This is another criminal offense that Hunter has not been charged for, one that we are forcing the Department of Justice to admit that they are tracking, as well as refusing to prosecute.”

In the brief filed Friday, the Oversight Project cites a significant amount of evidence that the Justice Department was indeed investigating Hunter Biden for Mann Act violations, including testimony from an IRS Whistleblower working on the Biden investigation to Congress that explicitly said as much.

The Mann Act, originally established to combat prostitution, makes it a felony to knowingly transport any woman or girl across state or international lines for the purposes of prostitution or debauchery, the outlet reported. The Oversight Project’s lawsuit is spurred by claims from IRS whistleblower Joseph Ziegler during a 2023 House Ways & Means Committee interview, where he discussed the DOJ‘s evaluation of potential Mann Act violations involving Biden.

Ziegler’s testimony highlighted Biden’s association with an individual on the West Coast, believed to be involved in the prostitution sector, from whom Biden allegedly deducted travel expenses. This raised questions about whether Biden facilitated the transport of individuals across state lines for illicit purposes, Fox News reported.

The legal brief, obtained by Fox News Digital, includes part of a 2023 interview transcript from IRS whistleblower Joseph Ziegler before the House Ways & Means Committee.

Ziegler recounted efforts by the Justice Department to assess potential Mann Act violations…[and] he understood the Justice Department to be “compiling” potential violation allegations that had been referred to them but that he did not know the ultimate outcome.

Oversight Project attorney Kyle Brosnan told Fox News Digital in a Thursday interview he believes the Justice Department, therefore, has the information and that it should be made publicly available.

In September, Reps. Marjorie Taylor Greene, R-Ga., and James Comer, R-Ky., wrote a letter to the Justice Department after IRS whistleblowers’ testimony, saying the witnesses indicated the agency “compiled a list of potential victims” in relation to a Mann Act probe into the first son.

“These women may be victims under the Crime Victims’ Rights Act and may also be afforded mandatory restitution pursuant to the Mandatory Victim Restitution Act,” Greene and Comer wrote.

In light of DOJ’s refusal to communicate in a meaningful way with the Committee, we have great skepticism that DOJ has been adequately communicating with crime victims. Considering DOJ’s public campaign purporting its commitment to prosecuting human trafficking and other sexual exploitation crimes, DOJ should respond to Congressional requests related to this issue in a timely and thorough manner
