Democrats’ J6 Committee Violates Separation of Powers

Congress was not established to conduct criminal investigations, and that’s exactly what the January 6th Committee is doing. Beyond the outrageous makeup of the committee, the entire endeavor is unconstitutional. This is a political ploy to prevent Donald Trump from holding office again in the future, and to humiliate conservatives like Josh Hawley along the way. Mark’s monologue this week is a searing indictment against the evils of the tyranny pervading our government.

What is the authority granted by the Constitution to Congress? Why does it matter?

– Congress doesn’t have plenary powers to do whatever it wants to do.
– Article I is a long list of powers. It’s the longest article in the Constitution.
– You will not find the power to conduct a criminal investigation because it violates separation of powers.
– Congress was never set up to conduct investigations of any sort. Or criminal investigations as part of a Justice Dept. or U.S. Attorney’s effort to target an individual or group of individuals.
– The entire enterprise of the January 6 committee is unconstitutional.

– What is very troubling: There is not a single judge in Washington DC who has reached that conclusion. Yet this goes to the heart of our Constitutional construct.
– You can’t have Joe Biden making legislation by executive orders just by claiming national emergencies.
– You can’t have Congress investigating – not for legislative purposes – but criminal purposes and to set up individuals and violate the Bill of Rights.
– You cannot have the courts legislating and executing.
– The whole thing becomes a mess. That’s what the left wants.
– The left does not believe in our Constitutional construct: Three separate branches; equal branches balancing and challenging each other, each fighting for their own turf. The left wants to control it all.
– The left uses Congress when the Democrats control the House or the Senate, particularly the House as a criminal investigatory body. And that’s exactly what is taking place. This is really appalling. If we intend to keep our republic, this needs to be called out.
– All the legal analysts on all the channels, they sit there and play the game: Former federal prosecutors, professors, former defense counsel, former this, former that. They get into the weeds about the hearing…

– We learned that this January 6th hearing is illegitimate for all the reasons I’ve talked about in the past (lack of opposition, exculpatory evidence, cross-examination, etc.) but because Congress isn’t supposed to be doing this.
– All these interviews that have been compelled by this committee – this one-sided committee – all those transcripts eventually are going to be turned over to the U.S. Dept. of Justice and the U.S. Attorney office to be used against these individuals.
– Those interviews would not be taking place – or it would be quite a different scenario if an ongoing criminal investigation – the U.S. Attorney’s office asked these individuals to provide depositions. Their lawyers would tell them, no. Unless they can cut some kind of deal.
All of that has been thrown out the window.

The latest hearing – the 8th hearing – what a joke this is.
– They tried to humiliate Senator [Josh] Hawley.
– The main witness, Nancy Pelosi, has been effectively immunized by the committee, members of whom she appoints, that she had to approve.
– Article I provides no such authority to the Congress of the United States.
– So everything they are doing – openly and affirmingly criminal in nature – is a violation of the separation of powers.

– Separation of powers goes back to [philosopher] Montesquieu; you can see in the Federalist Papers, the Framers of the Constitution mentioned Montesquieu.

The last hearing
– They had a grand ol time so cool trying to embarrass the former president and Sen. Hawley

What have we learned so far? 8 hearings:
We have learned nothing – nothing we didn’t already know.

These hearings have confirmed that Donald Trump had no direct role whatsoever in the January 6th violence inside the Capitol building.
– They did not present any. They had videos, texts, graphics, emails, documents, witnesses.
– Do you remember one sentence where Donald Trump directed or ordered or even encouraged a violent attack? Not innuendo, not opinion, not inference. But any actual fact? They have found any because there isn’t any.
– Despite 1000s witnesses (excluding Nancy Pelosi), 100,000s documents, months of investigations, they have found nothing!

187 minutes. For 2 years Democrats have not apologized for cheering Black Lives Matter.
– If he [Trump] were leading an insurrection, the video would not have been the video that he released. Basically telling supporters and others to stand down, to cut it out.
187 minutes (3 hours, 9 minutes): big deal
– You have members of this committee who still have not issued statements condemning the plot to assassinate Associate Justice to the U.S. Supreme Court Brett Kavanaugh. That’s longer than 187 minutes.
– There are members on this committee who were cheering Black Lives Matter. There were rioting, maiming, and even killing. It’s more than 187 minutes, we are on 2 years now.

Insurrection? If Donald Trump was seriously interested in an insurrection:
– His video would have not said what he said.
– His video would have been a call to arms.
– He’d call everybody who can hear his voice to come to the Capitol armed to take over the Capitol building. He’d have called out the U.S. military (whether they’d respond or not) to come to the Capitol building, and circle it and arrest the vice-president and arrest other officials, members of congress. That’s an insurrection!
– He would have declared Martial law. That’s an insurrection!
– Trump didn’t do any of those things.
– He didn’t do any of the things people told him he might want to do in order to “hold on to the presidency.”
– He didn’t send out the military to get voting machines (as some had suggested), he didn’t send out the Department of Homeland Security to get drop boxes (as some had suggested), he didn’t fire the acting Attorney General or the acting Deputy Attorney General (as some had suggested), he didn’t appoint a special counsel (as some had suggested). He didn’t do any of it. – But he would’ve done all of it, if he were actually leading an insurrection.

What they got
– We get disgruntled former administration employees.
– We get people giving their opinions and their inferences – all one-sided. This committee has had all the power to do whatever it wants.
– They have no fingerprints, no DNA, nothing of Donald Trump’s on the January 6 violence.

They are talking “Insurrection” (XIV Amendment)
– This committee is basically the point of the spear – a front operation- for the Attorney General of the U.S. and the U.S. Attorney both are politically partisan and corrupt.
– They dropped the cases against the ‘Colbert 9’ while they threw a 69-year-old grandmother, who is receiving cancer treatment, in prison for 60 days.
– They have done this to a lot of people – for trespassing and parading. We are not talking about violent crimes.
– How many Antifa people have been charged and have the book thrown for trespassing and parading?

They are hoping Donald Trump gets indicted. But no investigation for the Biden crime family.
– They are obsessed with Trump.
– They don’t want any investigation of Biden (the Manchurian president) and all the money he got. The Biden criminal family. All the money he got from these foreign entities.

Insurrection (Amendment XIV, Section 3 )

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”

– That’s why they keep using the word “insurrection” That’s why they keep trying to create this national impression that Donald Trump was involved in an insurrection.

– Why? Not only because they want Donald Trump indicted. Just in case they are putting together a report to accuse Trump of leading an insurrection. And then claiming he cannot serve in the presidency as a result – under the XIV Amendment.

– This has never been tried against a President or running for President. We don’t know how that is adjudicated. But they don’t care. They are reckless. Like their 2 impeachments and the criminal investigation of Trump, etc.

– I’m not a special pleader for anyone, I am a pleader for the U.S. Constitution. I don’t go along with the mob – and the mob is in control right now in the name of the Democrat Party. They control all the instrumentalities of government. They control almost every single news platform, almost every single college and university. They control the narrative.
I’m not going along with it.

– What this committee, U.S. Attorney, Attorney General, and the media are doing are repugnant to our Republic.
